Sale of Goods

Under The Sale of Goods Act 1979 (as amended) businesses must ensure that goods sold to consumers are ‘of satisfactory’ quality, which means that they have no major defects and, in some cases, that they are free from minor and cosmetic defects. The goods must fit any description of them given in any advertisement or orally and be fit for any obvious or specific purpose which the consumer has made clear on purchase.

Supply of Goods

The Supply of Goods and Services Act 1982 requires that businesses providing a service must ensure that their work is done to the standard and price agreed. In cases with no such agreement, the work should be carried out to a reasonable standard, at a reasonable cost and within a reasonable time. What is ‘reasonable’ is open to interpretation and will depend upon what other suppliers would have done in the same situation. For this reason Premier Solicitors believes that it is always better to have a written contract in place, and our lawyers can assist with the drafting or reviewing of such contracts.

Consumer Protection

The Consumer Protection Act 1987 provides for compensation for damage to property, injury or death cause by a faulty product. This means that manufacturers, producers, or importers, and in some circumstance the retailer may be liable.

Unfair Contract

The Unfair contract Terms Act 1977 and unfair Terms in Consumer Contracts Regulations 1994 allows consumers to object to unfair or unreasonable terms in contracts which they have entered into.
